Article 1. Purpose
The purpose of these general conditions of use is to define the conditions of use of the Service accessible on the clickandlive.com website, as well as to define the rights and obligations of Users (including in particular Artists and Organizers) and Click & Live in this context.
They may be supplemented, where applicable, by special conditions of use for certain Services, which must be duly agreed in writing between Click & Live and the party concerned. In the event of contradiction, the special conditions shall prevail over the general conditions.

Article 2. Definitions
Artist: Refers to any person or group, in a self-employed capacity (autoentrepreneur, company, association) or intermittent of the spectacle having created an account in order to propose an artistic service.
Organizer: Refers to any person or group, having created an account in order to search for an Artist for an Event.
Event: Refers to the offer proposed by the Organizer to host an Artist. Stage: Refers to a venue that can host an Artist.
Article 3. Organizer Party
3.1 Publication of an ad.
Each Organizer looking for an artist for an event can create an ad from the Site. This ad form contains several pieces of information to help find the artist who best matches the information written and published.
Before being published, the ad goes through a moderation phase.
3.2 Artist listing
Following the publication of an ad, artists with an account with the necessary information on clickandlive.com have the opportunity to apply for ads. The Organizer therefore receives a list of artists proposing themselves for the ad posted and accepting the elements announced in it.
3.3 Payment terms
When you make a purchase on our site via Up2pay e-Transactions, a Crédit Agricole service. The payment process is carried out directly in connection with the E Transactions server, via the TLS (Transport Layer Security) security protocol, which enables the encryption of data provided by yourself. Sensitive data, such as credit card numbers, are fully encrypted and protected to prevent the information exchanged from being intercepted in clear text by a third party during the transaction. Card numbers are instantly encrypted and are not accessible or stored on the E Transactions server, except for card data requested by customers to facilitate future purchases or to process split payments or deferred payments. Up2pay e Transactions is also certified PCI-DSS compliant.
By paying from the forms, you agree to Up2pay's service rules. It is also possible to make payment by bank transfer.
The customer's payment is retained by Click & Live until the time of the event.
3.4 Billing for the service
The artist's reservation is the subject of an invoice between Click & Live and the organizer. This invoice will be communicated by any useful means.
3.5 Condition of reception of artists
When hosting an artist for your event, certain conditions must be met: - a covered space sheltered from the rain if the event takes place outdoors - a space where artists can deposit their belongings

Article 4. Artist Party
4.1 Login as an Artist
Each Artist has the option of creating an account from the Site. After filling in certain information, the Artist may be contacted by Click & Live, from the e-mail or telephone provided, in order to review certain information drafted if necessary.
The Artist authorizes Click & Live to use and give the information indicated on the Artist file to an organizer for research and/or promotional purposes within the framework of an event.
4.2 Stage proposal
When an Artist matches an Organizer's search, the Organizer may be contacted to send stage and event information. If the Artist wishes to take part in this event, he/she will have to apply to the advert in question on the site. The Artist will be contacted following the Organizer's response. Whether positive or negative, the Artist will be kept informed.
In the event of a negative response, the Artist will no longer have the need to reserve that date. In the event of a positive response, the Artist will be put in touch with the Organizer.
The Artist will be informed of the date.
4.3 Payment for the performance
Following acceptance of the Event, the Artist will be asked to produce an invoice so that Click & Live can pay for the service by bank transfer.
Article 5. Cancellation Policy
5.1 Cancellation by the Organizer
If the organizer chooses to cancel his booking of an artist. The latter must contact Click & Live (by telephone on the number provided at the time of booking or via the email address: contact@clickandlive.com) to inform us of any changes concerning the booking. To cancel your booking properly, Click & Live must be informed of the cancellation before the artist. ClickAndlive will then handle cancellation discussions with the artist.
5.2 Refund following Cancellation by the Organizer
Full refund: If cancellation by the Organizer occurs within 7 days of booking and less than 14 days before the event, we will refund the Organizer the full payment, except for any fees incurred with our payment provider Crédit Agricole. 50% reimbursement: If the Organizer cancels less than 14 days before the event, 50% of the payment will be reimbursed, except for the costs incurred with our payment service provider Crédit Agricole. In this case, the Artist will receive 50% of the amount due for the event. No refund for the Organizer: In the event that the Organizer cancels less than 4 days before the event. This will not be refunded and the artist will receive the amount scheduled for the event.
5.3 Cancellation by the Artist
In the event that an artist is no longer available for your event. We undertake to offer the organizer an artist corresponding to his needs and at a similar price. If the artist is suitable, he or she will then be booked for your event.
If no solution is found following cancellation by the artist, Click & Live undertakes to refund the full amount of the booking.
Article 6. Duration - modifications to the GCU
These GCU are applicable for the duration of your browsing and access to the Site and for the duration of your use of the Site.
We reserve the right to modify these TOU at any time. Any modification will take effect as of the publication of the new version of the TOS. You agree to be notified of updated TOS by their publication on the Site.

By continuing to use or access the Site after the effective date of the updated TOS, you represent that you have read the updates and agree to all modifications made.
The latest version of the TOS available online on the Site shall prevail, where applicable, over any other version of these TOS.
Article 7. Applicable law and jurisdiction
The present contract is subject to French law. Failure to reach an amicable settlement in the event of a dispute between the parties implies recourse to the competent French courts to settle the dispute.
Article 8. Data collection
When writing a Form, the collection of information at the time of sending is necessary and mandatory. In accordance with law n°78-17 of January 6th relating to data processing, data files and individual liberties, the collection and processing of personal information is carried out with respect for privacy.
In accordance with the French Data Protection Act dated January 6, 1978, articles 39 and 40, the User has the right to contact Click & Live in order to delete and oppose his/her personal data.
Article 9. Intellectual property
The trademarks, logos and content of the clickandlive.com site (graphic illustrations, text...) are protected by the French Intellectual Property Code and by copyright. Reproduction and copying of content by the User requires prior authorization from the site. In this case, any use for commercial or advertising purposes is prohibited.
Article 10. Cookies
When visiting the site, the automatic installation of a cookie on the User's browsing software may occur.
